Heard Sri Ken Singh, learned counsel for the petitioner, Sri S.S. Sachan, learned A.G.A. for the State and perused the impugned F.I.R. as well as material brought on record.
This petition has been filed with the prayer to quash the F.I.R. dated 27.10.2018, registered as Case Crime No.572 of 2018, u/s 66 Information and Technology (Amendment) Act, 2008, added Section 420 IPC, P.S. Nawabad, district Jhansi.
Learned counsel for the petitioner submits that petitioner is having an account in the bank in question and Rs.40,000/- are stated to have been transferred in the said account. The petitioner was unaware of the said fact and he came to know about the forgery when he went to bank to withdraw his money which was released in his favour by Govt. of India under the scheme of Pradhan Mantri Avas Yojna and it was informed to him that his account has been seized on account of said fact. The present FIR has been lodged against the petitioner on account of suspicion only.
Learned A.G.A. opposed the prayer for quashing of the FIR.
Considering the submissions advanced by learned counsel for the parties and nature of the allegations, it is directed that the petitioner shall not be arrested in above mentioned case, till the submission of the police report under section 173(2) Cr.P.C. but shall co-operate with the investigation of the case.
With the above direction this petition is finally disposed of.
