Petitioner is aggrieved by the action of respondents in denying him appointment to the post of Goods Guard in India Railways.
Sri Vivek Rai, learned Standing Counsel submits that Indian Railways is notified under the Administrative Tribunals Act, and therefore, petitioner has remedy of approaching the Central Administrative Tribunal. Hon'ble Apex Court in L. Chandra Kumar v. Union of India, (1995) 1 SCC 400 has been pleased to hold that a writ petition ought not to be entertained directly against such action.
Leaving it open for the petitioner to approach the Central Administrative Tribunal, this petition is consigned to records.
