Heard learned counsel for the petitioner and learned AGA for the State.
This petition for writ is before us to quash the First Information Report dated 01.03.2018 bearing Case Crime No.94 of 2018 pending investigation at Police Station Manth, District Mathura for the offence under Sections 60, 63 U.P. Excise Act and 420, 467, 468, 471, 272 IPC.
Learned counsel for the petitioner submits that the arrest of co- accused Rahul Singh Rajput has already been stayed by a co- ordinate Bench of this Court on 22.03.2018 in Criminal Misc. Writ Petition No. 7079 of 2018.
In view of the fact that a coordinate Bench of this Court has already stayed the arrest of the co-accused Rahul Singh Rajput, the arrest of the present petitioner namely Arjun @ Mukesh is also stayed, in the case referred above, till filing of the police report as per the provision of Section 173(2) of the Code of Criminal Procedure, 1973. The petitioner shall co-operate the investigating agency in relation to the investigation in process.
The writ petition stands disposed of accordingly.
