Heard learned counsel for the petitioner and Shri Vivek Verma, learned counsel for Kanpur Development Authority.
In view of the order proposed to be passed, notices need not go to private respondents.
The plaintiff-petitioner is before this Court for a direction to Ist Addl. Civil Judge (SD), Kanpur Nagar to decide Original Suit No.18 of 2003 (Munish Kumar & Ors. v. Kanpur Development Authority, Kanpur Nagar & Ors.) within stipulated period.
Learned counsel for the petitioner states that the suit is at the evidence stage and on account of pendency of the said proceeding, the petitioner is sufferring irreparable loss and injury.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue and with the consent, the writ petition stands disposed of finally with a direction to the Civil Judge to consider and decide the aforesaid suit in accordance with law expeditiously and preferably within a period of one year from the date of production of certified copy of this order but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties, except upon payment of cost.
