JUDGMENT / ORDER

This S.C.C.Revision has been preferred beyond the period of limitation.
The revisionist has moved delay condonation application under section 5 of the Indian Limitation Act supported with an affidavit today itself.
Learned counsel for the respondent Sri Veer Singh is present. Therefore, no notice is required to be served upon the respondent. The respondent is directed to file his counter affidavit within a week.
List thereafter before appropriate Bench.
It is submitted by the learned counsel for the revisionist that the execution proceedings are going on and if the interim protection is not granted today then the revisionist may be evicted from the demised premises.
Till the next date of listing, the revisionist shall not be evicted from the demised premises provided he deposits the entire decretal amount within a week positively in the court below. The respondent will be at liberty to withdraw the amount so deposited by the revisionist without furnishing any security.
On prayer made by the learned counsel for the revisionist certified copy of this order be given to the revisionist today itself on payment of usual charges.
