The learned counsel appearing for the appellant submitted that the sole appellant died in the year 2013 and on 16.12.2013, he sent a letter to the appellant's address in order to get instructions with regard to impleadment of legal representatives, but the same was returned with an endorsement ?Addressee Died? and therefore, he is unable to take steps to bring on record the legal representatives of the deceased appellant on record and to that effect, he has filed a memo, dated 04.01.2017.
2. Recording the memo, dated 04.01.2017, the second appeal is dismissed as abated. No costs. Consequently, connected civil miscellaneous petition is closed.
