Heard Sri Ashish Kumar Pandey, learned counsel for the revisionist and Sri Vinay Saran, learned Senior Advocate, assisted by Sri Pradeep Kumar Mishra, learned counsel for opposite party no.2 and learned A.G.A. for the State.
A prayer has been made to set aside the order dated 28.03.2019 passed by Session Judge, Ghaziabad in Criminal Appeal No.40 of 2019 (Mohammad Shamshad Versus Arif and another) in Case Crime N. 612 of 2014 (State Versus Arif) under Section 302, 307, 452 and 506 I.P.C., Police Station Kotwali, District Ghaziabad whereby he has set aside the judgement and order dated 7.02.2019 passed by the Juvenile Justice Board, Ghaziabad declaring the revisionist as juvenile and remanded back to the Board to decide the application of revisionist to declare him juvenile in conflict with law afresh.
Learned counsel for the revisionist states that the order was passed by learned Sessions Judge,Ghaziabad on 28.03.2019 and after that he has no knowledge as to whether the Juvenile Justice Board has decided the claim of the juvenility of the revisionist or not.
In view of it, he prays that he may be permitted to withdraw the present revision.
The instant revision is dismissed as withdrawn. However, if the claim of the revisionist for declaring him juvenile has not yet been decided, the Juvenile Justice Board, Ghaziabad shall make every endeavour to decide the same within a period of two months from the date of production of a certified copy of this order before him.
