ORDER:
This writ petition is filed for the following substantive relief: “…to issue appropriate writ or order or direction preferably one in the nature of Writ of Mandamus declaring the action of respondent Nos.1 & 2 in charging the wheeling charges for the month of March, 2014 to September, 2014 on the petitioners company for transmission of solar energy is bad in law and against to G.O.Ms.No.39, dated 26.09.2012 and the A.P.Solar Power Policy-2012 by the A.P.Regulatory Commission as bad illegal, and further declare that the action of the respondent is not refunding the wheeling charges collected from the petitioners company in spite of the specific request made by the petitioners company 25.09.2014 (which was acknowledged by the Respondent Company on 27.09.2014) as illegal, void and consequently, direct Respondent Nos.1 & 2 not to charge wheeling charges from the Month September, 2014 onwards till a new policy supersedes G.O.Ms.No.39, dated 26.09.2012, and also direct the respondents to take action on the letter submitted by the petitioners company 25.09.2014 (which was acknowledged by the Respondent Company on 27.09.2014) with regard to refund of the amounts collected for the wheeling charges.”
At the hearing, Ms.Ch.Kanaka Durga, learned counsel, representing Sri N.Guru Gopal, learned counsel for the petitioner, requested for permission of the Court to withdraw the writ petition. Letter, dated 27.11.2014, is also addressed to the Registry to that effect.
In view of the same, the writ petition is dismissed as withdrawn.
As a sequel to dismissal of the writ petition, W.P.M.P.No.42031 of 2014 shall stand disposed of as infructuous.
