The petitioner's vehicle bearing registration No.KL-10AJ/6056 has been seized for transporting river sand without permit. The petitioner seeks release of the vehicle. The petitioner has alternate remedy under Sec.23A of the Kerala Protection of River Banks and Regulations of Removal of Sand Act. 2. In view of the above, there shall be a direction to the 2nd Respondent to report the seizure of the vehicle before the competent jurisdictional Magistrate within three days from the date of receipt of a copy of this judgment. If the petitioner makes an application before the competent jurisdictional Magistrate for the interim custody of the vehicle under Section 23A of the Kerala Protection of River Banks and Regulations of Removal of Sand Act, the Magistrate shall consider the application within a period of ten days from the date of moving such application. The 1st Respondent shall finalise the entire proceedings relating to the confiscation of vehicle within a period of two months from the date of receipt of a copy of this judgment, after affording an opportunity of hearing to the petitioner.
