This Company Petition is filed for an order to wind up the respondent for non-payment of the debt due to the petitioner.
Mr.Rupendra Mahendra, learned Counsel for the petitioner, stated that the respondent has issued postdated cheques, some of which have been encashed and two more cheques, dated 23-07- 2014 and 23-08-2014, are yet to be encashed.
Having regard to the factum of issuance of cheques by the respondent towards the debt due by it to the petitioner, the Company Petition is closed with liberty to the petitioner to seek its revival in the event either or both the aforesaid cheques are dishonoured.
