The instant application under Section 482 Cr.P.C. has been filed with a prayer to direct the Civil Judge (Senior Division) / Additional Chief Judicial Magistrate, Jhansi to decide the Complaint Case No. 432 of 2017 (Smt. Archana vs. Bhupendra Kumar and others), under Section 494 I.P.C., P.S. Prem Nagar, District Jhansi pending before the Court of Chief Judicial Magistrate, Jhansi.
Heard learned counsel for the applicant; learned A.G.A. for the State and peruse the record.
Learned counsel for the applicant submits that the aforesaid complaint case is pending since 16.2.2017 and opposite party no. 2/accused has appeared on 31.10.2018, but the trial has not been concluded, till date.
Record shows that the Trial Court proceeding is pending since 15.12.2018 for the statement of complainant/applicant at the stage of Section 244 Cr.P.C. Several opportunities have already been given to both the parties but statement has not been recorded so far.
In view of the above, Trial Court is directed to conclude the trial as expeditiously as possible within one year.
With the above observation, the instant applications is disposed off.
