Heard learned counsel for petitioners and learned AGA for State through video conferencing.
Learned counsel for petitioners at the very outset has drawn the attention of this Court to several orders passed by this Court in identical matters and one such order is contained in annexure 4 passed in writ petition no. 2407 (Misc. Bench) of 2021. It is submitted that the petitioners are covered by the orders passed by this Court which have discussed the similarity in detail and the position is not disputed by learned AGA.
Looking to the fact that the petitioners are also similarly circumstanced persons accused in the present case, we accordingly extend the benefit of orders passed by this court to the present petitioners for the same very reasons. We hereby provide that till the next date of listing or till the submission of police report under Section 173(2) Cr.P.C., whichever is earlier, the arrest of the petitioners in FIR no.287/2018 under Sections 471, 468, 467, 420 & 419 Police Station Kotwali Nagar District Balrampur shall remain stayed subject to the restraint that the petitioners shall fully cooperate in the investigation and appear as and when called to assist the investigation.
