Heard learned counsel for the applicant and learned A.G.A for the State as also perused the record.
This application under Section 482 Cr.P.C. has been filed seeking direction to the court below for early decision of application dated 16.2.2021 filed under Section 23 of the Protection of Women from Domestic Violence Act, in Case No. 2336 of 2020, u/s 12 of the Act, P.s. Beeta-2, District Gautam Buddh Nagar, pending before A.C.J.M.-III, Gautam Buddh Nagar.
Learned counsel for the applicant submits that during the court of pendency of aforesaid cast the notice was also served to the O.P. No.2 who is the husband of the applicant and he also filed objection. It is relevant to mention that during pendency of the aforesaid case, the applicant move an application for interim maintenance but even after appearance of the opposite parties, the case is listed for service of notice.
In view of the aforesaid, without expressing any opinion on the merits of the case, this application is finally disposed of with a direction to the court below to decide the aforesaid case in accordance with law, as expeditiously as possible, without granting any unnecessary or long adjournments to either of the parties, preferably within a period of two months from the date of production of a certified/computer generated copy of this order, if there is no other legal impediment.
