Heard learned counsel for the petitioner and Sri M.N. Singh, learned counsel appearing for U.P. Public Service Commission.
The petitioner appeared in the Combined State/Upper Subordinate Services Preliminary Examination-2017 conducted by the U.P. Public Service Commission. The petitioner is an OBC candidate. She has secured 57 marks in first Paper and 80 marks in second paper of the above preliminary examination i.e. a total of 137 marks.
Her contention is that in OBC category, the last candidate qualifying the preliminary examination has obtained 128 marks. Therefore, she has wrongly been omitted from the list of candidates qualifying for the main examination.
The argument is bereft of merit inasmuch as the merit of the preliminary examination has to be determined on the basis of marks obtained by a candidate in first paper and second paper is only a qualifying paper, wherein minimum 33 marks has to be obtained.
In view of the above, as the petitioner has only obtained 57 marks in first paper apparently she is much below the merit of last qualifying candidate in OBC category.
Accordingly, we find that the petition is devoid of merit and same is dismissed.
