High Court Of Judicature at Allahabad|11 February, 2021

JUDGMENT / ORDER

Heard learned counsel for petitioner and learned Standing Counsel for State.
Petitioner is a lady Police Constable posted at present at Kanpur. She has approached the respondents by a representation dated 23.01.2020 praying that she may be transferred from District Kanpur to District Lucknow as her younger brother aged about 14 years has suffered head injury impacting his mental condition and is under treatment at K.G.M.U., Lucknow. Her father is not alive and her mother is also old and there is no brother or other family members to look after her mother as well as her brother. Therefore, she alone has to look after them. On the said ground, she has prayed for transfer from Kanpur to Lucknow.
Learned counsel for petitioner after arguing at some length states that grievance of petitioner would be sufficiently met in case request to the petitioner for transfer from District Kanpur to District Lucknow on humanitarian ground is considered in a time bound manner.
Looking into the facts and circumstances of the case this Court is satisfied that petitioner is permitted to make a fresh detailed representation to respondent No.2, Additional Director General of Police (G.S.O. to D.G.P.), Head Quarter Police Directorate, U.P. Lucknow raising all her grievance, annexing therewith a copy of this writ petition along with annexures, and all the documents in support of her claim within a period of two weeks from today along with a certified copy of this order.
In case such a representation is moved by petitioner, respondent No.2 shall consider and decide the same in accordance with law by a reasoned and speaking order within a period of two months from the date a certified copy of this order along with representation is placed before him.
It is made clear that this court has not applied itself on the merits of the case and all questions are left open to be considered and decided by the competent authority in accordance with law.
With the aforesaid directions, the writ petition is disposed of.
