Heard learned counsel for the applicant, learned AGA for the State and perused the record.
This application under Section 482 CrP.C. has been filed by the applicant with a prayer to direct the Court below (learned Principal Judge, Family Court, Hamirpur) to decide Case No. 31 of 2014 (Smt. Archana and another versus Sarnam Singh Chauhan), under Section 125 Cr.P.C., within stipulated period.
Learned counsel for the applicant has submitted that her application under Section 125 Cr.P.C., is pending since 31.7.2014 and till date, the same has not been decided and has been lingering-on, on one pretext or the other.
In view of the above, learned court below is expected to make all endeavours to decide the aforesaid case as expeditiously as possible, preferably within a period of four months from the date of filing of certified copy of this order without giving any unnecessary adjournments to either parties, if there is no other legal impediment in deciding the aforesaid case.
With the aforesaid direction, this application under Section 482 Cr.P.C. is finally disposed of.
