It shows that the sum and substance of the report is that the maintenance due under the maintenance order is not being made good by the husband. There are some dates when the applicant has not appeared before the Family Court.
Be it as it may, the Principal Judge, Family Court cannot lay her hands off the matter of enforcement of the maintenance order with words to the effect that the husband is not complying, despite being ordered, and that the next date fixed is 02.04.2021. Enforcement of a maintenance order is a very urgent matter. The report shows that after 12.01.2021 the next date fixed is 02.04.2021.
In the circumstances, the Principal Judge, Family Court, Mathura is ordered to fix a date every week in the pending case under Section 125(3) Cr.P.C. that is to say Case No. 1721/XII/2019 and proceed with enforcement of the maintenance order adopting all necessary measures required for the purpose. In every event, the maintenance order will be enforced within a period of six weeks, unless there be a stay granted by a Court of superior jurisdiction.
This application is disposed of in terms of the aforesaid order.
Let this order be communicated to the Principal Judge, Family Court, Mathura by the Joint Registrar (Compliance) within 24 hours.
