Mr.Dakshesh Metha, learned advocate for the petitioners does not press this application for petitioner no.2-Kantibhai Gobarbhai Chaudhary, but, it is submitted that the petition is pressed for petitioner no.1-M/s.Arbuda Builders.
Mr.Mehta, learned advocate for the petitioners took me through copy of complaint, so also the copy of disputed cheque and the common order dated 26.06.2007, passed in Criminal Misc. Application No.3107 of 2007 with Criminal Misc. Application No.3103 of 2007, whereby the instant complaint came to be quashed qua the petitioners of those matters.
Having considered the submissions advanced by learned advocate Mr.Mehta, so also considering the above referred papers, Notice returnable on 13th February,2012.
Mr.K.P.Raval, learned Additional Public Prosecutor for the respondent no.1-State appears and waives service of notice for the respondent no.1-State. In the meanwhile, ad-interim relief in terms of Para-19(B) is granted for the petitioner no.1 only.
