For Petitioner : Mr.S.Sugendran For respondent : Mr.R.Sekar, Govt. Advocate (Crl.Side) ORDER This Criminal Original Petition is filed seeking to modify the condition imposed by the learned Judicial Magistrate Court No.VI, Coimbatore, in Crl.M.P.No.1102 of 2017 dated 26.05.2017.
2. It is submitted by the learned counsel for the petitioner that the petitioner is working in a Private company and therefore, he could not comply with the condition of two Government employees surety and further, he could not produce the property deed for Rs.15,00,000/-. It is further stated that since the petitioner could not comply with the conditions of bail order dated 26.05.2017, he is still in jail. Further the petitioner is the breadwinner of the family and prayed for modification of the condition.
3. Heard the learned Government Advocate (Crl.Side), on the above submissions.
4. Considering the facts and circumstances of the case, the condition imposed by Judicial Magistrate No.6, Coimbatore, dated 26.05.2017 is modified and the petitioner shall execute a bond for a sum of Rs.10,000/- with one Government surety and the petitioner shall furnish title security to the extent of Rs.5,00,000/- (Rupees Five Lakhs only), at the time of execution of bail bond and Time granted for executing the order dated 26.05.2017 will stand further extended for a period of two weeks from the date of receipt of a copy of this order. The other conditions imposed by the above said court shall stand unaltered.
5. The Crl.O.P., is disposed of with the above direction.
