JUDGMENT / ORDER

Divergent orders passed on an application for temporary injunction are impugned. It is unnecessary to delve deep into all the aspects since the suit itself is ripe for trial. I direct the Court of the Munsiff of Kodungalloor to dispose of the suit in O.S. No. 1735/2012 expeditiously. Every endeavour shall be made to dispose of the suit within a period of three months from today.
2. The parties to the suit shall maintain the status quo as reported by the Advocate Commissioner in the meanwhile. I make it clear that the use of the pathway by any of the parties pending suit will not confer any special right on them. A gate can be provided at either ends of the pathway which can also be locked and both the parties can have a key of the same. This arrangement shall continue till the suit is finally disposed of.
3. The Court of the Munsiff is directed to dispose of the suit untrammeled by the orders impugned.
The Original Petition is disposed of.
