Heard learned counsel for petitioner, learned A.G.A. on behalf of the State and perused the record.
By means of present writ petition, the petitioner has prayed for quashing of impugned First Information Report dated 10.09.2020 lodged at F.I.R./Case Crime No.0306 of 2020, under Sections 419, 420, 467, 468, 471 IPC, P.S. Wazeerganj, District Lucknow.
Learned counsel for petitioner submits that the petitioner while applying for the post in question had made the application in physical form, whereas verification of the documents was done through online at Madhyamik Shiksha Parishad site. There may have been some fault in uploading of the documents at the site of U.P. Madhyamik Shiksha Parishad for which the petitioner cannot be held responsible. It is submitted that the petitioner has also annexed the photocopy of mark sheet of intermediate examination which is a genuine document.
After hearing learned counsel for parties and going through the record, without expressing any opinion on the merits of the case, the writ petition is disposed of with the observations that till filling of the police report under Section 173(2) Cr.P.C., or till any cogent evidence is found, whichever is earlier, petitioner shall not be arrested in connection with the aforesaid F.I.R. number. However, the petitioner will co-operate with the investigation.
