ORDER:
This Writ Petition is filed for a Mandamus to declare the inaction of the respondents in implementing order, dated 23.12.2013, in C.G.No.1170/2013-14/Ranga Reddy, So u t h Circle, of the Consumer Grievances Redressal Forum, APCPDCL, Hyderabad.
At the hearing, Sri O.Manoher Reddy, learned Standing Counsel for the respondents, submitted that since the petitioner himself has filed an appeal before the Vidyut Ombudsman under Section 42(6) of the Electricity Act, 2003, the respondents have not implemented the above-mentioned order. He has further submitted that in view of pendency of the appeal before the Vidyut Ombudsman, the respondents have not questioned the order of the Consumer Grievances Redressal Forum and that once the appeal is disposed of, they will avail their judicial remedy of filing a Writ Petition questioning the said order.
Sri Vedula Srinivas, learned counsel for the petitioner, submitted that the very purpose of filing such appeal before the Vidyut Ombudsman was to enforce implementation of order, dated 23.12.2013, of the Consumer Grievances Redressal Forum.
A perusal of appeal, dated 28.07.2014, of the petitioner supports this submission of the learned counsel for the petitioner.
In the above facts and circumstances of the case, the respondents are directed to implement order, dated 23.12.2013, of the Consumer Grievances Redressal Forum without prejudice to their right to question the said order by availing appropriate remedy before the competent forum.
The Writ Petition is, accordingly, disposed of.
As a sequel to disposal of the Writ Petition, W.P.M.P.No.37817 of 2014 filed by the petitioner for interim relief stands disposed of as infructuous.
