Heard learned counsel for the applicant and the learned A.G.A. for the State.
This application under Section 482 Cr.P.C. has been filed with the prayer to direct the learned Additional Chief Judicial Magistrate, Kasya Kushinagar to decide the Case No. 1091 of 2017(State vs. Rishiraj) arising out of Case Crime No. 215 of 2016, under Section 498-A, 323, 504 IPC, 3/4 D.P. Act, Police Station Kasya, District Kushinagar within a stipulated period.
Learned AGA submitted that applicant is the complainant. However, direction may be given for early disposal.
This Court is of the view that early disposal of the case is the right of any person.
Having regard to the facts and circumstances of the case and having considered the submissions made by the learned counsel for the parties, the Court below is directed to decide the aforesaid case according to Section 309 Cr.P.C. expeditiously fixing short dates, if there is no any legal impediment. It is further directed that the applicant will cooperate in the trial and no unnecessary adjournment will be sought/granted.
With above observations,the application stands disposed of.
