JUDGMENT / ORDER

Ramachandra Menon,J
Petitioner is before this Court alleging harassment by police/the respondents 1 to 3, at the instance of 4th respondent. The case of the petitioner is that, the property belonging to the petitioner was agreed to be sold to the 4th respondent by executing Ext.P1 on 13.12.2012. A portion of the sale consideration was given as advance. But, the 4th respondent, according to the petitioner, turned back from the deal and he did not perform his part by virtue of which the petitioner is stated as entitled to appropriate the advance amount already paid in terms of said sale agreement. It was at this point of time, that the 4th respondent chose to invoke the assistance of police, to get back the said amount. It is stated that the petitioner is being summoned to the police station, almost every day, which made W.P.(c) No.12738 of 2014 2 him to approach this Court by filing this writ petition.

Today, when the matter taken up for consideration, the learned Government Pleader submits, on instructions obtained from respondents 1 to 3, that the police has not caused any harassment to the petitione. On receiving petition/complaint as to the alleged offences, the matter was sought to be enquired into. It is also stated that the enquiry made in this regard revealed that the transaction was purely a 'civil' one and in such circumstances, no steps are being pursued against petitioner and that the police does not require the presence of the petitioner.
In the above circumstances, this Court finds that no further orders are necessary. The submission made by the learned Government Pleader is recorded and the matter is disposed of accordingly.
