The present Civil Application has been filed by the Applicant for bringing the heirs on record of Opponent No.1, who is Opponent No. 1/1 as stated in the Application.
Heard learned Advocate Ms. Dhara M.Shah for the Applicant and learned Advocate Mr. Sunil C.Patel for the Opponents.
In the facts and circumstances, with consent, the prayer in terms of paragraph 8(a) and (b) is granted. The Applicant is permitted to bring the heir of Opponent No.1, I.e. Opponent No.1/1 on record as the heir of the Respondent in the aforesaid First Appeal No.4989 of 2007. Learned Advocate Ms. Dhara Shah shall carry out the amendment within a week.
Rule is made absolute.
