Appearance: vs Served For

The respondents, though served, have not filed their appearance. Respondent No.2 has, however, sent a letter addressed to the Registrar seeking direction to the applicant to forward complete paper book to enable it to defend the appeal. However, while considering the application for condonation of delay, rules do not require that the opponents shall be furnished with complete paper book. Even otherwise, considering the averments made in the application, delay is condoned. Rule is made absolute accordingly with no order as to costs.
