Thie following substantial questions of law are involved in this appeal.
1) Whether in the facts and circumstances of the case, the Lower Court erred in deciding the issues after holding that it had no jurisdiction to decide the suit and the lower court should have returned the plaint for presentation to the proper Court ?
2) Whether in the facts ande circumstances of the case on true and correct interpretation of the document of title Exs.93 which is a registered sale deed dated 30th April, 1982, the plaintiff had become owner of the land in question and whether he was in possession of the suit land till the defendants encroached upon the same ?
As these substantial questions of law arise in this Second Appeal, the appeal is 'ADMITTED'. Mr. J.B.Pardiwala saives service on behalf of the respondents. R&P to be called for. Main appeal to be placed for final hearing on 4th February, 1997.
