1. Applicants seek condonation of delay of 529 days occurred in filing the First Appeal.
2. Rule issued by this Court is already served. However, nobody has appeared for the respondent.
3. Having gone through the contents of the application, especially the averments made in para 3 of the application, we are satisfied that the applicants have sufficiently explained the delay occurred in filing the first appeal. Averments made in para 3 of the application go to show that delay has occurred mainly because of the procedural reasons stated by the applicants as files for the purpose of taking approval for filing appeal as also for getting approval on other aspects were required to be moved from one department to other department. In view of this explanation, we are inclined to allow this application. Accordingly, this application is allowed. Delay is condoned. Rule is made absolute.
4. Office shall, now, place the First Appeal for admission hearing on 9th April 2012.
