(Per : HONOURABLE MR.JUSTICE A.J. DESAI) The present application is filed for condonation of delay of 52 days in preferring the above mentioned O.J. Appeal.
We have heard learned Advocate for the applicant. Though served, none appears on behalf of the opponent.
Considering the contents of the application, it cannot be said that the delay caused in filing the aforesaid O.J. Appeal has remained totally unexplained. Therefore, we are of the view that the delay caused in filing the aforesaid O.J. Appeal deserves to be condoned. Accordingly, this application is allowed. Delay of 52 days caused in filing the aforesaid O.J. Appeal is condoned. Rule is made absolute.
