1. Learned advocate for the applicant has stated that pursuant to order dated 1.3.2012 passed by this Court, applicant has deposited entire amount of award with proportionate costs and interest with the Reference Court, which comes to Rs.15,52,365/-.
2. In response to Rule issued by this Court, nobody has appeared for the claimants. We, therefore, confirm the stay granted by us vide order dated 1.3.2012. We also permit respondent Nos.3 and 4- claimants to withdraw 50% of the amount deposited by the applicant. Remaining 50% of the amount shall be invested in Fixed Deposit Receipt, in any nationalized Bank, initially for a period of five years, to be renewed from time to time till the first appeal is finally heard and decided.
3. Application is allowed. Rule is made absolute accordingly.
