(Per : HONOURABLE MR.JUSTICE A.L.DAVE) This is an application for condonation of delay of 67 days caused in preferring Letters Patent Appeal.
2. Heard learned advocate Mr. Shalin Mehta for the applicant and learned advocate Mr. Mehul S. Shah for respondent No.7. Though respondent Nos.1 to 6 are served with the notice of rule, they have chosen not to contest this application.
3. In light of the averments made in the application, it cannot be said that the delay has remained totally unexplained. Therefore, we are of the view that the delay caused in filing the Letters Paten Appeal deserves to be condoned. Accordingly, the application is allowed. Delay is condoned. Rule is made absolute. No costs.
