1. Present application is for condonation of delay of 42 days in preferring the Appeal against the judgment and decree passed by learned Civil Judge in Special Civil Suit No.51 of 2002.
2. The respondent is served and Mr.Saurabh Kumar Singh, Manager-Legal of the respondent has appeared on behalf of the respondent. He placed on record the authority given by the Company as per the Board's resolution dated 29.7.2011.
3. Considering the facts and circumstances and in view of the grounds stated in the application for condonation of delay, since sufficient cause is made out, the delay deserves to be condoned. Hence, the delay is condoned.
4. Application is allowed to the aforesaid extent. Rule is made absolute accordingly.
