Mr.Kodekar, learned APP waives service of notice of Rule on behalf of the respondent-State.
The applicant seeks temporary bail on the ground of her own treatment as she is patient of Epilepsy . The applicant has been in jail since long. In support, medical opinion of Dr. Bindu Goswami, Medical Officer, Vadodara Central Jail, Vadodara is annexed with the application which supports the basis of filing of application by the applicant.
In view of the facts and circumstances of the case and taking into consideration the jail remarks of applicant application is allowed.
The applicant is, therefore, ordered to be released on temporary bail for a period of THIRTY DAYS, from date of her actual release on her executing a personal bond of Rs.5,000/- (Rupees Five Thousand Only) before the Jail Authorities on certain conditions that she will;
a) not leave the State of Gujarat.
b) not indulge in any illegal activity.
c) surrender to the Jail Authorities in time.
Rule is made absolute to the aforesaid extent.
