Appearance vs Mr Rc Kodekar Addl.Public ...

High Court Of Gujarat|03 May, 2012

JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE A.L.DAVE) Pursuant to a Notice, respondent Nos.3 and 4 have produced the corpus. We have talked to her. She is educated and without dispute she has attained majority.
2. During our talk with the corpus, we find that the petitioner and the corpus were known to each other for number of years and since their relationship was not approved by respondent Nos. 3 and 4, they decide to get married and accordingly they got married. Thereafter, the corpus decided to stay with her father. It appears that the sister of respondent No.3 was aware about the relationship and marriage of petitioner and the corpus. She, in turn, informed respondent No.3 about the marriage and since then corpus was not permitted to contact the petitioner.
3. We have talked to respondent Nos.3 and 4 and their son Agast. It is clear that they do not agree with relationship of petitioner and the corpus for their domestic personal reasons, mainly that the petitioner and corpus have been neighbours for number of years and the corpus and the petitioner are brought up together. Second grievance is that the petitioner is not earning well.
4. During talk with the corpus, we found that the marriage was solemnized after performing rituals and the girl accepted the relationship. She wants to go and stay with the petitioner. She has apprehension about strained relationship but still she is firmed about her going and staying with the petitioner. She is a major, she is even otherwise legally wedded wife of the petitioner and, therefore, she cannot be denied the fulfillment of her wish of going and staying with her husband-the petitioner. Petition, therefore, deserves to be allowed, the same is allowed. The corpus Shivaniben is free to go and stay with the petitioner. The petition stands disposed of accordingly. Notice is discharged.
