Mr. R. C. Kodekar, learned Additional Public Prosecutor, waives service of notice of Rule on behalf of respondent-State.
The convict through his brother has filed the present application seeking temporary bail for period of 30 days on the ground of marriage of son of the convict which is fixed on 25.04.2012.
We have gone through the jail record of the convict. He has spent eight years and three months in the jail by now. During his stay in the jail, he enjoyed temporary bail more than once. Lastly he was released on temporary bail in the month of March, 2012 for attending engagement ceremony of his son and has surrendered in time.
In view of the above, application is partly allowed. The convict is, therefore, ordered to be released on temporary bail for a period of ONE WEEK, so as to cover the date of marriage of his son, on his executing a personal bond of Rs.5,000/- (Rupees Five Thousand Only) before the Jail Authorities on certain conditions that he will;
a) not leave the State of Gujarat.
b) not indulge in any illegal activity.
c) surrender to the Jail Authorities in time.
Rule is made absolute to the aforesaid extent. Direct Service today is permitted.
