(Per : HONOURABLE THE ACTING CHIEF JUSTICE MR.BHASKAR BHATTACHARYA) After hearing the learned counsel for the parties and after going through the materials on record, we find that by our order dated December 21, 2011, while disposing of an application for vacating interim relief, being Civil Application No. 13024 of 2011, we have considered in detail the entire material on record including the affidavit of Municipality. While passing such order, we specifically recorded that there was no deviation from the sanctioned plans and the proposed construction was in conformity with the bye-laws of the Corporation and consequently, we vacated the earlier order of status quo.
In view of the aforesaid position, we do not find any reason to continue further with this Public Interest Litigation and accordingly we dispose of the same in terms of our order dated December 21, 2011 passed in Civil Application No. 13024 of 2011.
The writ-petition stands disposed of accordingly.
In view of the above order passed in the main petition, the Civil Application does not survive and stands disposed of accordingly.
Notice is discharged in both the matters. No order as to costs.
