1. The applicants complain of non-compliance of the directions issued by learned Single Judge in Special Civil Application No.13243 of 2011 on 2.9.2011. By the said order, respondents were required to consider the representation of the petitioners within stipulated time frame. When this was not done, petitioners moved present contempt petition.
2. In reply to notice issued, learned Assistant Government Pleader appeared on behalf of the respondents. He has tendered today an affidavit dated 25.4.2011 sworn by Shri Rajesh Kishore, Principal Secretary, Health and Family Welfare Department, Gandhinagar.
3. From the pleadings on record, it emerges that the applicants are clamoring for grant of appropriate pay scale after stagnation for specified number of years of service. From the reply of the respondents, it also emerges that their cases are under active consideration by the competent authority. It is however, stated that the entire procedure would involved calling for DPC and consideration of C.Rs. and other material relating to the applicants. This may take further time. It is also stated that the respondents have moved Misc. Civil Application for extension of time for compliance. Learned Assistant Government Pleader stated under the instructions from Dr. J.M. Upadhay, Deputy Director, Ayurved, that such decision shall be taken within two months. On such assurance and expectation of the respondents to take final decision latest by 25th June 2012, this contempt petition is closed at this stage.
4. Disposed of accordingly. Notice is discharged.
