Rule. Ld. Govt. Counsel Mr. S.R.Divetia waives service of the rule. The prisoner is before us asking for temporary bail for a pretty long time, on the ground that, his mother of the advanced age requires surgical treatment. The medical certificate given by the Medical Officer Dhrangadhra hospital would go to show that, the mother of the prisoner requires surgical treatment because she has developed certain gynaecology problems. Upon the notice being given to the State, Ld. Govt. Counsel Mr. Divetia for the State submits Report dated December 19,1996, issued by the DSP, Surendranagar, saying that, previously when the prisoner was on interim bail he was found not behaving in a proper fashion. The complainant and certain witnesses have expressed apprehension that, there could be a breach of peace. This aspect of the matter can be taken care of by imposing certain conditions of the movements of the prisoner. In our opinion, the purpose would be served if the prisoner is granted temporary bail for a period of two weeks to be commenced from 23rd. December 1996. During this period, the prisoner shall ordinarily stay at Wadej, Ahmedabad, and in no case he shall not enter the limits of Dhrangadhra town. The prisoner shall give personal bond in sum of Rs.1000-00 before the concerned jail authorities. Rule is made absolute. D.S. permitted. The Report being submitted by Ld. Govt. Counsel be taken on record. The prisoner should be sent back to the concerned jail.
