JUDGMENT / ORDER

Rule. Ld. Govt. Counsel Mr. S.R.Divetia waives service of the rule. The present petition in our opinion requires a partial recognition. Prisoner Dineshbhai Patel is before us, asking for the temporary bail for a period of two weeks, on the ground that, his father was admitted in the hospital on 13th November 1996 and has been discharged on the very next day, but that, his condition is not satisfactory and that; the medical expert has advised complete rest for a period of two weeks. The certificate dated 15th. Nov.1996 was annexed to the petition. It has been issued by Dr. Shukla, Consulting Physicial & Cardiologist of Ahmedabad. The Report of the police has also come. More over Ms. Parmar, learned counsel for the petitioner hands over a fresh certificate issued by Dr.Shukla dated 21st. Dec.1996, saying that, the father of the prisoner is suffering from Left Ventruler Failure and as his condition is not satisfactory, he needs personal care of a near relation.
In our opinion the purpose would be served, if the prisoner is granted the temporary bail for a period of ten days, to be counted from the date of his actual release. The prisoner shall deposit an amount of Rs.2,000-00 before the jail authorities concerned. Rule is made absolute. D.S. permitted.
