Appearance: vs Public Prosecutor For

High Court Of Gujarat|09 February, 2012

JUDGMENT / ORDER

The applicant is convicted under the provisions of the N.D.P.S. Act. He has already preferred an appeal, which is pending in this High Court. He has applied for parole, which has been rejected by invoking Section 32A of the N.D.P.S. Act. In certain petitions, challenge has been made for denying remissions, etc., which are pending in this Court. Admittedly, the applicant is convicted some time in the year 1988 and Section 32A came to be incorporated by way of an amendment in the year 1989. It is, therefore, necessary to consider this application after the petitions, challenging the denial of remission by invoking Section 32A of the N.D.P.S. Act, are decided one way or the other. Hence, tag this matter with Special Criminal Applications Nos. 374 of 1996 and 375 of 1996.
