(Per : HONOURABLE THE ACTING CHIEF JUSTICE MR.BHASKAR BHATTACHARYA) By our order dated March 16, 2012, we issued notice upon the respondents making it returnable on April 13, 2012. Further, being prima facie satisfied with the case made out by the petitioners, we also granted interim stay of operation of the demand on condition that the petitioners will deposit 50% of the amount demanded within a period of fortnight from that date and will give security by way of bank guarantee regarding the balance 50% of the amount within the aforesaid period.
By this application, the applicants have prayed for extension of time to deposit the amount and to furnish Bank Guarantee.
After hearing Mr. Soparkar, the learned senior advocate appearing on behalf of the petitioners and after going through the records, we are satisfied that sufficient cause has been made out for extension of time for deposit of amount and for giving Bank Guarantee.
We, accordingly, extend the time for deposit of the aforesaid amount till April 12, 2012 and for furnishing Bank Guarantee till April 27, 2012; in default of payment of the amount and furnishing Bank Guarantee within the extended time, the interim order will stand vacated.
The Civil Application is disposed of accordingly.
Let the main matter appear on its returnable date.
