Appearance: vs Oral Order

High Court Of Gujarat|16 July, 2012

JUDGMENT / ORDER

The petitioners have challenged the order dated 4th December 1995 passed by the learned Civil Judge (J.D.), Dhrol, below Exh.46 in Regular Civil Suit No. 41 of 1990, as well as the order dated 2nd May 1996 below Exh.51 for review of the order dated 4th December 1995, whereby the petitioners herein were ordered to be joined as defendants in the suit.
In my opinion, the learned Judge has exercised his discretion properly after taking into consideration the fact that the petitioners had purchased the suit land and, therefore, they are necessary parties for proper adjudication of the suit. There is no error of jurisdiction pointed out by the learned advocate for the petitioners. Therefore, it cannot be said that the order passed by the learned Judge is illegal or passed under wrongful exercise of jurisdiction conferred upon him. Hence, this Civil Revision Application is rejected summarily.
