1. Office has placed this appeal with a note dated 21.3.2012, stating that this appeal was left out from the group of other appeals which have been finally decided and disposed of by the Division Bench of this Court earlier on 22.12.2010.
2. We find that the facts of this appeal are similar and identical to the facts of First Appeal No.749 of 2010, which is disposed of as stated above. In view of this position, this appeal is admitted. Since the issue involved in this appeal is covered by the judgment of this Court in First Appeal No.749 of 2010, we fix this appeal for final hearing on 9th April 2012.
3. Office shall issue notice of admission of this appeal to the respondents-claimants, making it returnable on 9th April 2012.
