(Per : HONOURABLE THE ACTING CHIEF JUSTICE MR.BHASKAR BHATTACHARYA) After hearing the learned counsel for the parties and after going through the records, we find that in this matter, a Division Bench of this Court, by order dated January 25, 2012 passed a specific direction that the respondent should not take coercive steps for recovery of any of the dues, with a further direction upon the officers of the petitioner to cooperate with the investigation and make themselves available for interrogation as and when called.
It appears that the summons dated 9th/12th March 2012 under section 14 of the Central Excise Act, 1944 has been issued upon the Managing Director of the petitioner Company, asking him to appear in person on March 23, 2012 at 11.00 Hours.
Mr. Trivedi, learned senior Advocate appearing on behalf of the petitioner submits that his client will comply with the directions contained in the summons and in such a situation, Mr. Ravani, learned counsel appearing on behalf of the Revenue submits that if the said Director complies with the summons and cooperate, his client will not take any coercive steps as indicated in the order dated January 25, 2012.
Let the matter appear for further orders on March 28, 2012.
