(Per : HONOURABLE MR.JUSTICE AKIL KURESHI) Finding that the original record came to be destroyed by the Trial Court, we had in our order dated 5.3.2012, called for explanation from the concerned Court. Pursuant to such direction, one Smt. R.H. Jani, In-charge Registrar, City Civil and Sessions Court has sent explanation dated 17.3.2012, along with which, letter of one Smt. C.C. Shah, Assistant Superintendent dated 17.3.2012 is annexed. From the letter, it appears that due to mixing of file, though the appeal is pending, original record came to be destroyed before the Court below.
Learned counsel Shri R.A. Patel for the claimants stated that he is in possession of typed copies of the depositions and other documents which he received from his briefing advocate. He stated that he would file such documents along with affidavit of the briefing advocate, certifying that such documents are true copies of the original depositions and other documents.
