JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE D.H.WAGHELA) The appellant has invoked clause 15 of the Letters Patent to challenge order dated 23.01.2012 of learned single judge in Special Civil Application No.808 of 2012 whereby the appellant's petition for appointment on the basis of the select list prepared by the respondents was rejected. Admittedly, the impugned judgment has adopted the line of reasoning elaborated in an earlier judgment of learned single judge of this Court in Special Civil Application No.16824 of 2011. Learned counsel fairly submitted that the Letters Patent Appeal preferred from the aforesaid elaborate judgment has also been dismissed and, therefore, no argument is advanced on merits. He fairly stated that the appeal was filed in view of the fact that several similarly situated employees have succeeded in the Supreme Court on the basis of a statement made on behalf of respondents and the present appellant also proposes to carry the matter to the Supreme Court. Therefore, the appeal is summarily dismissed without any discussion on merits.
