(Per : HONOURABLE MR.JUSTICE D.H.WAGHELA) It was stated by the appellant, appearing as party-in-person that as per the agreement recorded in previous order dated 02.12.2011 herein, he is paid the amount of Rs.32,000/- by a cheque by respondent Nos. 1 and 2. He further stated that subject to realization of the cheque, he does not propose to press the appeal for any further order and requested that it may be disposed as withdrawn. Learned counsel Mr. Hakim, appearing for respondent Nos.1 and 2, submitted, on instructions, that the cheque of Rs.32,000/- already given to the appellant shall be honoured and realized. Therefore, the appeal is disposed as withdrawn with no order as to costs and with liberty to revive the appeal in case the cheque received by the appellant is not honoured.
