(Per : HONOURABLE MR.JUSTICE V. M. SAHAI) 1 Heard the learned Counsel Mr. C.B. Upadhyaya for the appellant and learned AGP Ms. Jirgha Jhaveri for the respondent - State.
2 The present intra-court appeal has been filed challenging the order dated 10.10.2011 passed by the learned Single Judge in Special Civil Application No.12515 of 2011 on the ground that though the interim relief was granted to the appellant in the Revision Application by the Secretary, Revenue, but, subsequently, the interim relief was vacated. The learned Single Judge did not interfere with the said order passed by the Secretary, Revenue, in the writ petition.
2.1 Having heard the learned Counsel for the appellant, we do not find any illegality in the Order dated 10.10.2011 passed by the learned Single Judge, however, since the Revision of the appellant is pending before the Secretary, Revenue, since 2010, interest of justice would be served if a direction is issued to the Secretary, Revenue, to decide the Revision of the appellant in accordance with law after hearing the concerned parties within a period of three months from the date of certified copy of this Order is produced before it.
3 With the aforesaid direction, the present appeal stands disposed of accordingly.
