Parikh, Mr. Mukesh A.Patel, for Mr. Arpit Patel learned Advocates appearing for the respective parties and learned AGP Mr. N.J. Shah for the respondent - State.
2 Learned Advocate Mr. H.M.Parikh, appearing for the appellants makes a statement before us that the present appeal, being Letters Patent Appeal No.1497 of 2009 has become infructuous and the same may be disposed of accordingly.
3 In view of the aforesaid statement made by learned counsel for the appellant, Letters Patent Appeal No.1497 of 2009 as well as Civil Application No.8439 of 2009 in Letters Patent Appeal No. 1497 of 2009 are dismissed as having become infructuous.
4 Mr.
Mukesh Patel and Mr. H.M. Parikh, learned Counsel appearing for the respective parties in Special Civil Application No.11071 of 2009 have agreed that since the Letters Patent Appeal No.1497 of 2009 is dismissed as having become infructuous, Special Civil Application No.11071 of 2009 has also become infructuous and the same may also be disposed of accordingly.
5 In view of the aforesaid statement made by learned counsel for the parties, Special Civil Application No. 11071 of 2009 also dismissed as having become infructuous. Notice is discharged.
5 At this stage, learned Counsel Mr. Mukesh Patel states that Special Civil Application No.10929 of 2009 is not listed today and the same may be called for and be disposed of accordingly as the same also becomes infructuous. Hence, the Special Civil Application No. 10929 of 2009 is called for from the Registry.
6 In view of the aforesaid statement made by learned Advocate Mr. Mukesh Patel, Special Civil Application No. 10929 of 2009 is also dismissed as having become infructuous.
