Rule. Ld. Government Counsel Mrs. Ami Yagnik waives the service of rule for the Respondent State. Upon hearing learned counsel for the petitioner and learned counsel for the State, it appears that, in the facts and circumstances of the case the present petition requires a recognition.

The glaring fact is that, under the panchanama of the scene of occurrence itself an amount of Rs.11,990-00 came to be recovered. The petition requires to be allowed. It is hereby accordingly allowed. Petitioner is hereby ordered to be released on bail in sum of Rs.5000-00 and the P.B. of like amount. Rule made absolute accordingly. D.S. permitted.
